Does your neighbor's tree block your light? What does the Civil Code of Catalonia establish?

With the arrival of good weather, the use of gardens and terraces highlights many common conflicts between neighbors. One of the most frequent is the trees that, due to their height or volume, generate excessive shadows , loss of natural light or invasion of branches and roots into the adjacent plot.

What do the regulations say about planting distances?

In Catalonia, neighborhood relations and tree spacing distances are strictly regulated by the Civil Code of Catalonia (CCCat) :

  • Legal planting distances ( Art. 546-5 CCCat ): A minimum distance must be respected with respect to the boundary of the neighboring property or dividing line:

    • 2 meters for trees with a high crown, large trunk or tall growing species.

    • 50 cm for shrubs, hedges or small plants.

  • Affectation by branches and roots ( Art. 546-6 CCCat ): If branches or roots invade neighboring property, the affected owner has the right to demand that they be cut. In the case of roots, if they do not meet the requirement, the affected person can cut them directly along the boundary of their property.

  • Prohibition of illegitimate immissions ( Art. 546-13 CCCat ): The right of property does not protect harmful use or abuse. If a tree completely deprives the adjacent property of direct sunlight or causes demonstrable damage, an immission not permitted by law is occurring.
